CONCERNING
AMENDMENT TO
THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 110/MPP/KEP/1/1998
ON THE PROHIBITION OF PRODUCTION AND TRADING OF OZONE DEPLETING SUBSTANCES
AS WELL AS RODUCTION AND TRADING OF NEW GOODS USING OZONE DEPLETING SUBSTANCES

THE MINISTER OF INDUSTRY AND TRADE,

Attachment

Considering :

a. that in the Decree of the Minister of Industry and Trade No. 110/MPP/Kep/1/1998 methyl bromide is stipulated as one of the ozone depleting substances whose production and trading are banned;
b. that since methyl bromide is still required as a fumigant for quarantine, for warehouse and preshipment purposes and pursuant to the exception of the Copenhagen Amendment, the use of the substance remains permitted;
c. that in connection with the above matters, it is necessary to amend the Decree of the Minister of Industry and Trade No. 110/MPP/Kep/1/1998;
d. that to this end, it is necessary to issue a decree of the Minister of Industry and Trade to this effect.

In view of :

1. Presidential Decree No. 61/1998 on the status, tasks, organisational structures and working procedures of ministries;
2. Presidential Decree No. 122/M/1998 on the establishment of the Development Reforms Cabinet;
3. The Decree of the Minister of Agriculture No. 711/Kpts/TP.270/1997 on the extension of registration and licensing of pesticide with methyl bromide as an active substance;
4. the Decree of the Minister of Industry and Trade No. 110/MPP/Kep/1/1998 on the prohibition of production and trading of ozone depleting substances as well as production and trading of new goods using ozone depleting substances.

DECIDES:

To stipulate:

THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE CONCERNING AMENDMENT TO THE DECREE OF THE MINISTER OF INDUSTRY AND TRADE NO. 110/MPP/KEP/1/1998 ON THE PROHIBITION OF PRODUCTION AND TRADING OF OZONE DEPLETING SUBSTANCES AS WELL AS PRODUCTION AND TRADING, OF NEW GOODS USING OZONE DEPLETING SUBSTANCES.

Article I

To amend the Decree of the Minister of Industry and Trade No. 110/MPP/Kep/1/1998 by supplementing Article 4A between Article 4 and Article 5, which reads as follows:

"Article 4A

(1) Especially with regard to methyl bromide, HS No. 2903.30.000, its trading shall be allowed as long as it is used as a fumigant for quarantine, for warehouse and preshipment purposes.

(2) The methyl bromide traded as meant in paragraph (1) shall bear labels with the words: USED ONLY FOR QUARANTINE, WAREHOUSE AND PRESHIPMENT PURPOSES as contained in the attachment to this decree.

(3) Other provisions concerning labels shall be according to pesticide licensing provisions stipulated by the Minister of Agriculture."

2. The other provisions contained in the Decree of the Minister of Industry and Trade No. 110/MPP/Kep/1/1998 shall remain valid.

Article II

This decree shall come into force as from the date of stipulation.

For public cognizance, this decree shall be announced by publishing it in the State Gazette of the Republic of Indonesia.
